Yesterday the Buganda Road Magistrate’s court ruled that Makerere University researcher Dr. Stella Nyanzi has a case to answer in relation to offences of cyber harassment and offensive communication.
Nyanzi is accused of writing an impolite birthday poem for President Museveni in which she attacked the Late Esteri Kokundeka, mother of President Museveni.
Buganda road magistrate Glady’s Kamasanyu ordered Nyanzi to start preparing her defense arguing that prosecution through their three witnesses had been able to prove the elements of the charges against her.
The Prosecution witnesses included Detective Bill Ndyamuhaki attached to the Police department of Cyber Crimes, Detective Harriet Kenyana attached to Media crimes division of Police and Charles Dalton Opwonya a member of the Pornographic control Committee.
Magistrate Glady’s noted that she had read the Original face book post several times as posted by Nyanzi and analyzed the evidence brought before her keenly and she has been convinced beyond doubt that Nyanzi has a case to answer.
Evidence brought before court included Activation codes used by Stella Nyanzi to create her Facebook account, Documents showing the numbers that activated the account, a copy Nyanzi’s passport that is reportedly have been used to register the numbers from MTN Uganda among others.
Nyanzi who has been in Prison for the last 230 days since November 2018 was directed by Magistrate Kamasanyu to prepare her defense for presentation on 26th June 21, 2019, July 1st ,3rd ,5th , Lawyers representing Nyanzi Derrick Bazekuketta and Isaac Semakadde also informed court that their client intends to bring five to seven witnesses who will defend her.
Stella who was seen in high spirits despite the ruling which her lawyers were displeased with. She said the ultimate goal of this case should be to educate the nation! This is an important case for freedom of expression and the right to offend. The use of public insult and radical rudeness against public figures and political leaders should be a given!
Nyanzi was arrested last year 2018 and has since refused to apply for bail.
