Dr. Stella Nyanzi was today set free after Justice Peter Adonyo of the High Court repressed the conviction against Dr. Stella Nyanzi related to cyber-harassment a case she has been battling for the last 18 months.
Court Ordered that Nyanzi is released immediately which prompted the fully packed court to explode in excitement as Dr. Nyanzi’s supporters, friends, and relatives jostled to congratulate her.
A few minutes later she collapsed as she was being helped to go sign her release papers and later re-arrested by Prison warders and civilian attire men who were later seen carrying her to a waiting prison car registration number UG 0172U.
Nyanzi has been in Jail since November 2018 in a case in which she was accused of cyber harassment and offensive communication against President Museveni and his mother, in August 2018 she was sentenced to 18 months Prison for harassing President Museveni but had already served 9 months.
After she was served with an 18 Months sentence, Dr. Stella Nyanzi appealed the conviction and sentence citing unfairness and that the trial court erred in law.
Today Thursday, 20, 2020 Justice Henry Peter Adonyo who heard her appeal ordered for her “immediate release” from prison and noted that the Buganda Road trial magistrate, Gladys Kamasanyu had no jurisdiction to convict Dr. Nyanzi of cyber harassment.
Justice Adonyo added that there was no evidence adduced by the prosecution pin Dr. Stella Nyanzi such as location- of the device- where the offense was committed; either Uganda or out of the country.
Court also observed that Dr. Nyanzi and her lawyers were not allowed enough time to prepare their defense thus amounting to unfairness adding that the first prosecution witness did not provide a forensic report on his findings indicating which mobile data was used after he asserted that Dr. Nyanzi might have used a phone.
Despite Dr. Stella Nyanzi serving all her 18 months in Jail and Court ordered for her release, She has been re-arrested and bundled into a Prison Car registration number UG 0172U to a yet to be known destination.
