The Commander of land forces also complainant in the offensive communication case Lt. Gen Muhoozi Kainerugaba has through the Uganda Police Force defied an order from court to release novelist Kakwenza Rukirabashaija unconditionally despite lawyers serving them with documents on Tuesday.
Mr Rukirabashaija was arrested last year on December 28 and he has since been in detention without access to his lawyers or family.
On January 4, Makindye Chief Magistrate Court, Grade One Magistrate Irene Nambatya ruled: “It is hereby ordered that the applicant be unconditionally released from police custody. Every police officer should comply with the above order”.
Kakwenza’s wife has gone further to sue the Attorney General, Police IGP, and Gen Muhoozi saying that her husband was brought home during a house search with his pants stained with blood.
The arrest of Kakwenza came after his verbal attack on General Muhoozi Kainerugaba whom he termed as a drunkard, weak, lazy and unfit to succeed his father as President of Uganda.
Meanwhile, Government has run to court to appeal the ruling of Makindye magistrates court judge Irene Nambatya who declared the unconditional release of writer Kakwenza Rukirabashaija citing the expiry of the lawful 48 hour custody timeframe.
